Under the Employment Equality (Age) Regulations 2006 employers are not permitted to treat employees less favourably because of their age (subject to some exceptions). This protection has existed from 1st October 2006 and gives older employees legal protection against discrimination on the grounds of their age. This applies to obvious cases of direct discrimination, such as verbal abuse on the grounds of age and also where decisions are made that favour younger or older applicants for no other reason than their age. With both the average population age and retirement ages on the way up more and more employees may require to consider their entitlement to protection under these relatively new regulations.
